The essay replies to comments by Finnis, Gardner and Endicott, on my book, Law as a Moral Idea. It is questioned whether Finnis is right to suggest that governance by law is a requirement of justice. It is suggested that Hart's positivism may have rested upon an unduly private conception of morality. Gardner's suggestion that Law as a Moral Idea falsely manufactures disagreement with Hart is rejected, principally by pointing out that Gardner focuses upon only one issue, where the book (...) already acknowledges that Hart might conceivably agree, and ignores other issues where the disagreement with Hart seems indisputable. In response to Endicott, it is acknowledged that 'politics' could be understood as a moral idea comparable to the idea of 'law', but denied that this robs either thesis of interest. The nature of doctrinal reasoning and law's justificatory force is then discussed. (shrink)

Diyanet İşleri Başkanlığı, 3 Mart 1924’te, Şeriye ve Evkaf Vekaleti’nin yerine kurulmuştur. Bu düzenleme ile dini konular, siyasal alanın dışına çıkarılıp idari bir işleve indirgenmek istenmiştir. Ancak bu tercihin aksine kurumun görev ve yetkilerinde ve teşkilatında artan ve büyüyen bir seyir ortaya çıkmıştır. Diyanet İşleri Başkanlığı’na kurulduğundan bu yana birçok misyon yüklenmiştir. Dinin devlet tarafından kontrol edilmesi, daha çok kurucu iradenin ve militan laiklik taraftarlarının beklentilerini yansıtırken, dini nitelikli hizmetlerin karşılanması ise daha çok muhafazakâr kesimin beklentisi olmuştur. Her iki taraf (...) da kurumu, Türkiye’nin sosyal, tarihsel ve siyasal dokusunun sui generis niteliğiyle meşrulaştırmaya çalışmıştır. Özellikle 633 Sayılı Kanun’dan (1965) sonra Başkanlık, sosyal hayatın daha çok içinde olmaya başlamış ve 1980 sonrası dönemde sosyal ve milli dayanışmanın sağlanması için bir araç olarak görülmüştür. Bu durum, 1982 Anayasası’nın korporatist ve solidarist özelliklerinin bir yansımasıdır. Diyanet İşleri Başkanlığı’nın bu şekilde araçsallaştırılması onun yıllar içinde bu derece büyümesinin temel itici gücü olmuştur. (shrink)

One feature of socialism that has been little discussed in the recent revival of interest in Marx is the basic form of economic organization that will characterize such a society. Marx's view, to be documented in what follows, is that socialism would not have a market economy. This prediction should be a matter of some embarrassment or consternation to twentieth-century socialists outside of the Soviet bloc who claim a Marxist heritage. Despite the fact that some socialist regimes in the first (...) half of this century did carry out a program of abolishing the market, the abolition of markets is no longer on the agenda for developed and developing countries. On the Left, anyway, some form of market socialism seems to be the preferred alternative; Yugoslavia is often pointed to as an imperfect real world exemplar of what market socialism might be like. From the earliest times, the very existence of Soviet power to combat religion and tirades, along with methods of economic and ideological pressure, actively using legal factors, is a rather strict system. Following the massive unveiling of solidarity and white army officials who were unable to leave the peninsula in November 1920, they began to form in the Crimea various branches of government, including their judicial system, which was published in a new regime of elements of legitimacy. However, the legal (...) system created on the peninsula was annexed to a radical political system, so when there were various problems, they were members of principles of political expediency, not morality and rights. The glorious Sophia image of Nikolai Mokrogo, now completely forgotten, was the oldest national shrine and one of the first miraculous icons of Kievan Rus known to us. The name of the icon is associated with the "Miracle of the Infant in Kiev", which dates from the researchers no later than 1090. The legend tells about the marriage, which went to the pilgrimage to the relics of Boris and Gleb in Vyshgorod. They returned to Kyiv by the Dnipro in a (...) boat. In the road, a tired woman was asleep and dropped into the water a baby, which immediately drowned. Parents of the child turned to despair in despair. Mykola "having a great faith in him", asking for help. Indeed, the next morning the child of a bud was found undisturbed on the outside of the chambers of Sophia of Kiev: "... the child is lying wet in front of the image of St. Nikolai "[Leonid, Archimandrite. Life and miracles of St. Nikolai Mirlykysky and praise him. Investigation of two monuments of ancient Russian writing of the XI century. - St. Petersburg, 1881. - P. 90.] The icon of the saint, under which was found miraculously saved sv. Nicholas is a child in wet diapers, nicknamed Nikolay Mokrogo. For centuries it was located on the choirs of the St. Sophia Cathedral in the iconostasis of the Mykolaiv altar, on the right of the royal gates, occupying the place of the temple image. (shrink)

Molla Halil’e göre insanların bu dünyada yaptıkları iyiliklere karşılık Yüce Allah onları ahirette lütfuyla nimetlendirecek ve Cennetine koyacaktır. Bu, Allah’ın insanlara bir va‘didir. Allah va‘dinden asla dönmez. Çünkü Allah’ın va‘dinden dönmesi, O’nun hakkında bir eksiklik sayılır. Ancak bu durum O’nun için vucûbiyet ifade etmez. Vucubiyet kavramı çeşitli anlamlarda kullanıldığı için anlam kargaşasına yol açabilir. Buna sebebiyet vermemek için kelamda özellikle de bu makalede “zorunluluk” anlamına kullanılacak olup bazen gereklilik anlamı da ihtiva edebilir. Allah, kötülük yapanları ise adaletiyle cezalandıracaktır. Bu da (...) Allah’ın va‘îdi olup, va‘îdi’nden dönebilir. Bu, O’nun hakkında bir noksanlığa sebebiyet vermez. Çünkü cezalandırmaktan vazgeçmesi Allah’ın merhametinin ve lütfunun bir sonucudur. Bununla birlikte ne va‘d ve ne de va‘îd Allah’a vacip değildir. Molla Halil’e göre, büyük günah insanı imandan çıkarmaz. Mu‘tezile’ye göre büyük günah işleyen kimse dünyada ne mümin olur ne de kâfir ikisinin arasında bir yerde durur. Buna da fasıklık denir. Haricîlere göre ise, ister büyük, isterse küçük olsun, her türlü günah sahibini iman dairesinden çıkarır ve küfür dairesine dahil eder. Molla Halil’e göre, ahiret hayatı ruh ve cesetle birlikte olacaktır. Bu üm-metin günahkârlarına peygamberler, şehitler ve salih kimseler şefaat edecek-tir. Mu‘tezile‘ye göre şefaat sadece iyilerin derecesinin yükselmesi içindir. Günahkârlar için şefaat olmayacaktır. Günahkâr müminler Cehenneme girseler de ebedi kalmayacaklar. Kâfirlerin azapları ise devamlı olacak ve bunlar ebedi olarak Cehennemde kalacaklardır. Biz bu makalede önce sevap ve İkâb kelimelerinin lügat ve ıstılah anlamları üzerinde duracak, sonra bu bağlamda ayet ve hadislerde verilen bilgileri ve bunların açıklamalarını ele alacağız. Daha sonra Molla Halil’in bu konulara dair görüşlerini sunmaya çalışacağız. Onun sevap ve İkâb ile ilgili tanımlarını, bunların sonuçlarına dair yaşanacakları ve varılacak yerleri ele alan yaklaşımlarını sunmaya çalışacağız. Burada farklı görüşlere sahip olmaları nedeniyle çoğunlukla Mu‘tezile’nin ve az da olsa Haricilerin görüşlerine de mukayese oluşturması için değineceğiz. Burada sadece Molla Halil’in görüşlerini değil, onun içinden geldiği Ehli Sünnetin görüşlerini, sünni kaynakları temel alarak aktarmaya çalışacağız. (shrink)

Sobre dialéctica recoge las principales aportaciones –inéditas en su mayor parte– de Manuel Sacristán Luzón (1925-1985) en torno a esta debatida noción, entre las que se incluye el importante prólogo que escribió en 1964 para su traducción castellana del Anti-Dühring, prólogo que Javier Muguerza ha caracterizado como “el texto filosófico más significativo de Sacristán –el que más me impactó cuando lo leí y prolongó más duraderamente dicho impacto” y del que Gregorio Morán escribió que “otro tanto ocurrió con su soberbio (...) prólogo al Anti-Dühring…; fue un texto capital en la formación marxista de una generación”. Como señaló Sacristán, y tal como reflejan los distintos textos que configuran este volumen, la dialéctica es una visión global del mundo, no un método, y una hipótesis de estas características no se aplica: se realiza, se concreta, y para ello hay que trabajar de verdad y verazmente. Miguel Candel Sanmartín, Manuel Monleón Pradas y Félix Ovejero Lucas son los autores del prólogo, nota final y epílogo del volumen. Antoni Domènech ha traducido para esta edición la “Loa a la dialéctica” de Brecht. Manuel Sacristán Luzón (Madrid, 1925-Barcelona, 1985) estudió Derecho y Filosofía y Letras en la Universidad de Barcelona y cursó estudios de lógica y epistemología en el Instituto de Lógica Matemática e Investigación de Fundamentos de la Universidad de Münster (Westfalia, Alemania) entre 1954 y 1956. Sacristán se doctoró en Filosofía en 1959 con una tesis sobre Las ideas gnoseológicas de Heidegger y en 1964, dos años después de que le fuera negada la cátedra de lógica de la Universidad de Valencia, publicó Introducción a la lógica y al análisis formal, uno de los textos que más contribuyeron a la presencia y consolidación de la lógica formal en la cultura científica y filosófica española. Profesor de “Fundamentos de Filosofía” y de “Metodología de las ciencias sociales” en la Universidad de Barcelona, impartió durante el curso 1982-1983 dos seminarios de postgrado en la UNAM de México. Miembro del comité central del PCE y del PSUC, entre 1965 y 1970 formó parte del comité ejecutivo del PSUC. En su faceta de filósofo marxista, destaca la sensatez y originalidad con que siempre trató el complejo, y en ocasiones oscuro, tema de la dialéctica y su concepción del marxismo como una tradición de política revolucionaria. De uno de los escritos aquí recogidos, Félix Ovejero Lucas señaló en 1985: “Apenas veinte páginas tenía la introducción de Manuel Sacristán a la edición castellana del Anti-Dühring, de Engels; veinte páginas que enseñaron a varias generaciones de marxistas mucho más acerca de lo que significaba ser marxista que la marabunta editorial de unos años más tarde”. The article summarizes and critically analyzes the encyclical letter of Pope Benedict XVI “Deus Caritas est.” This document discusses “diaconia” in the Roman Catholic Church in view of its biblical and theological foundations, its characteristics, and the position of works of mercy within the general self-understanding of the church. In going beyond the text, the author emphasizes the political dimension of church-based charity, the need to respond to the challenge of the principle of solidarity by contemporary neoliberal tendencies, and the (...) relationship of the church to those employed in the service of her diaconia.
